Ce dernier garantissait un loyer pay\u00e9, ainsi qu\u2019une assurance maladie, l\u2019\u00e9cole des enfants et plusieurs allers retours pour toute la famille. Pour les cadres fran\u00e7ais, ce contrat leur permettait de garder leurs droits sociaux (\u00e0 savoir leurs droits \u00e0 la retraite et leurs cinq semaines de conges pay\u00e9s). C\u2019\u00e9tait le contrat pr\u00e9f\u00e9r\u00e9 des grandes entreprises qui envoyaient leurs cadres dans cette terre inconnue mais pleine d\u2019avenir qu\u2019\u00e9tait alors la Chine.\n<p>Les taux de croissance \u00e0 deux chiffres, la promesse d\u2019une classe moyenne \u00e9mergente pr\u00eate \u00e0 s\u2019approprier le mode de vie capitaliste et une main-d\u2019oeuvre sur place peu ou pas qualifi\u00e9e qui ne parlait pas anglais, justifiaient de tels contrats. C\u2019\u00e9tait alors plus b\u00e9n\u00e9fique pour les entreprises d\u2019envoyer un cadre de confiance sur place que de recruter localement.<\/p>\n<p>Le contrat local pour \u00e9trangers \u00e9tait alors presque inexistant et ne concernait que quelques \u00e9coles chinoises en qu\u00eate de professeurs d\u2019anglais peu qualifi\u00e9s ou certaines petites entreprises \u00e9trang\u00e8res qui voulaient cro\u00eetre en Chine mais qui ne poss\u00e9daient pas la puissance financi\u00e8re pour offrir de tels avantages \u00e0 leurs salari\u00e9s. Les conditions d\u2019embauche r\u00e9gies par le droit chinois y \u00e9taient \u00e9videmment bien moins attrayantes, et les contrats souvent douteux aux yeux du droit.<\/p>\n<p>Nous voici d\u00e9sormais en 2015. La situation s\u2019est invers\u00e9e : les contrats d\u2019expatri\u00e9s sont d\u00e9sormais rarement renouvel\u00e9s et ils sont souvent remplac\u00e9s par des contrats locaux.<\/p>\n<p>Alors que s\u2019est-il pass\u00e9 ?<\/p>\n<p>D\u2019une part, la crise financi\u00e8re de 2008 est pass\u00e9e par l\u00e0, for\u00e7ant les entreprises \u00e0 tailler dans leurs budgets. Celles-ci rechignent d\u00e9sormais \u00e0 expatrier leurs cadres. Cela co\u00fbte trop cher et en plus, cela s\u2019est trop souvent montr\u00e9 contre-productif : en effet ces derniers se sont parfois montr\u00e9s peu enclins \u00e0 comprendre le contexte culturel, ce qui n\u2019a pas aid\u00e9 \u00e0 la p\u00e9n\u00e9tration ni \u00e0 la compr\u00e9hension du march\u00e9 chinois.<\/p>\n<p>Mais pas seulement.<\/p>\n<p>La vraie r\u00e9volution est surtout \u00e0 chercher dans la constitution d\u2019une main-d\u2019oeuvre qualifi\u00e9e sur place. Il s\u2019agit soit de Chinois partis \u00e9tudier en Europe, en Australie ou aux \u00c9tats-Unis, puis rentr\u00e9s chez eux, ce qu\u2019on appelle les <em>\u00ab\u00a0sea turtles\u00a0\u00bb<\/em> ; soit d\u2019\u00e9trangers install\u00e9s de longue date ici et parlant la langue parfaitement.<\/p>\n<p>Dans les deux cas, ces derniers apportent une connaissance aigu\u00eb du terrain et ne justifie nullement l\u2019expatriation d\u2019un cadre.<\/p>\n<p>Un chef d\u2019entreprise \u00e0 la recherche d\u2019un DG pour sa filiale chinoise m\u2019expliquait la semaine derni\u00e8re qu\u2019il ne ferait jamais venir quelqu\u2019un d\u2019Europe. Il \u00e9tait bien plus \u00ab\u00a0rentable\u00a0\u00bb et \u00ab\u00a0logique\u00a0\u00bb pour lui de recruter localement quelqu\u2019un de familier avec le march\u00e9 chinois.<\/p>\n<p>On s\u2019achemine donc aujourd\u2019hui vers un march\u00e9 du travail qui ressemble bien plus \u00e0 ce qu\u2019on conna\u00eet en Europe. Ainsi, \u00e0 cette nouvelle g\u00e9n\u00e9ration qualifi\u00e9e bas\u00e9e en Chine, n\u2019est pas propos\u00e9e un contrat d\u2019expatriation comme pr\u00e9c\u00e9demment mais un contrat \u00ab\u00a0local\u00a0\u00bb qui est en fait un super contrat chinois ou un contrat \u00ab\u00a0d\u2019expat-local\u00a0\u00bb. M\u00eame si \u00e9videmment les conditions varient d\u2019une entreprise a l\u2019autre, y est pr\u00e9vu un salaire \u00e9quivalent \u00e0 ce que le travailleur toucherait chez lui, sans les plus de l\u2019expatriation: billets d\u2019avion, loyer ou \u00e9cole des enfants pay\u00e9s. Seuls 12 jours de vacances sont accord\u00e9s.<\/p>\n<p>C\u2019est en soit un contrat bien moins avantageux qu\u2019avant. Cependant ces contrats restent tr\u00e8s attractifs pour de jeunes cadres car le salaire y est \u00e9lev\u00e9 et ces derniers ont souvent plus de responsabilit\u00e9s que chez eux. Le dynamisme du march\u00e9 du travail fait que la Chine reste une destination attractive pour beaucoup.<\/p>\n<p>Alors le \u00ab\u00a0contrat d\u2019expat\u00a0\u00bb tant pris\u00e9 existe-t-il encore ? Oui, r\u00e9pondent les grands cabinets de recrutement: pour des projets tr\u00e8s sp\u00e9cifiques ou dans des domaines de niches (IT, ing\u00e9nierie, finance, etc.). Et pour ces cadres-l\u00e0, le contrat ne fait que s\u2019am\u00e9liorer. La Chine \u00e0 cause de la pollution est d\u00e9sormais consid\u00e9r\u00e9e comme un <em>\u00ab\u00a0hardship posting\u00a0\u00bb<\/em>. Comprendre : une destination difficile.<br \/>\nDans ces conditions, certaines grosses entreprises doivent faire monter les ench\u00e8res pour motiver leurs cadres \u00e0 d\u00e9m\u00e9nager. Les salaires peuvent ainsi grimper jusqu&rsquo;\u00e0 20 % par an (soit bien plus que le co\u00fbt de la vie). Dans certains cas, un logement pour la famille est pr\u00e9vu \u00e0 Singapour, S\u00e9oul  ou Hong Kong o\u00f9 l\u2019air est plus respirable que dans les m\u00e9gapoles chinoises.<\/p>\n<p>Alors oui, le march\u00e9 du travail \u00e9volue en Chine pour les \u00e9trangers qui sont de plus en plus employ\u00e9s avec des contrats locaux.
